  1. CONTENT OF PERSONAL DATA

According to the Law, "Personal Data" is understood as any information related to an identified or identifiable individual or legal entity. For the purposes of this Privacy Notice, in an enunciative but not limiting manner, "Personal Data" shall be understood as "Personal Data":

  1. a) General information: Name of the legal entity, name of the attorney-in-fact or legal representative, name(s) and surname(s), date of birth, sex, marital status, whether or not there are children, address, landline telephone (home or office), cell phone, e-mail, Federal Taxpayers Registry (RFC), Unique Population Registry Code (CURP), tax regime, specification of payment methods (cash, vouchers, checks, bank accounts, deposits and/or visas), voter identification card (IFE) folio number, among other similar data concerning a person.
  1. b) Sensitive personal data: Sensitive personal data includes information on: racial or ethnic origin, present and future health status, genetic information, religious, philosophical and moral beliefs, union membership, political opinions, sexual preference.

In order to comply with the purposes set forth in this notice, if personal data of this type is collected, it will be treated under security measures, always guaranteeing its confidentiality.

 If you do not express your opposition by means of the revocation request for ARCO rights, it will be understood that you have given your consent for the collection of such data under the terms stated herein.

Consent: "By receiving this notice, I express my willingness as owner of the data, for SHEKINAH to carry out the treatment of the same, understanding as treatment the collection, use, disclosure or storage of personal data, by any means. The use includes any action of access, handling, use, use, transfer or disposal of my personal data".

  1. c) Data related to job applications: When Personal Data is entered or provided in SHEKINAH's job exchange, in addition to general data, information about educational level, work experience and any information related to the job application filled out or the resume that is submitted or sent will be considered Personal Data.

The information provided to social networks in which SHEKINAH participates as a user, is not part of the Personal Data subject to the protection of this Privacy Notice, being the responsibility of the company providing that platform and who publishes it.

  1. f) Cookies: Cookies are text files that are automatically downloaded and stored on the hard disk of the user's computer equipment when browsing a specific page or Internet portal, which allow the Internet server to store certain data, including preferred pages for viewing on the Internet, some keys and passwords.

SHEKINAH will use cookies to determine your preferences when you connect to the services of our site. For the aforementioned, from this moment, the user gives his consent to SHEKINAH to keep in their records both physical and electronic, all information that has been provided to us through any means of those made available by SHEKINAH in order to collect your Personal Data.

The Processing of Personal Data by SHEKINAH shall be subject to the provisions of the following point.

  1. PURPOSES OF THE PROCESSING OF PERSONAL DATA

Through this Privacy Notice, SHEKINAH declares that the purposes of the processing of your Personal Data will be the following ("Processing Purposes"):

  1. a) Informative purposes: in order to publicize the information and commercial work of SHEKINAH.

  1. e) Recruitment and selection of personnel, in the event that the user applies for any of the vacancies in the SHEKINAH job bank and receives information about job offers or vacancies that arise within the company.

  1. ACCEPTANCE OF THE PROCESSING OF PERSONAL DATA

The personal data that you have provided directly or through electronic means to SHEKINAH have been collected and will be treated by SHEKINAH under the principles of legality, consent, information, quality, purpose, loyalty and responsibility in accordance with the provisions of the Law.

  1. LIMITATIONS ON THE USE OF PERSONAL DATA

In case the Data Subject wishes to limit the use of his/her Personal Data, in relation to one or more of the purposes of the Processing of Personal Data (for example, advertising mailings, birthday greetings, market research, among others), he/she may send the corresponding request according to the process stipulated in point VII of this Privacy Notice.

VII. RIGHTS OF ACCESS, RECTIFICATION, CANCELLATION OR OPPOSITION (ARC RIGHTS)

In accordance with the provisions of the Law, the Data Subject has the right to access, rectify, cancel or oppose the Processing of his/her Personal Data, for which the following procedure must be followed:

  1. a) As a Personal Data Subject, submit or send a request for access, rectification, cancellation or opposition to the following e-mail address srodriguez@shekina.mx addressed to the person responsible for the processing of your data.
  1. b) Resolution and communication SHEKINAH will communicate to the Personal Data Holder the determination made within a period not exceeding 15 business days from the date on which the request was received. This term may be extended by SHEKINAH on a single occasion for an equal period, provided that it is justified by the circumstances of the case.

In accordance with the provisions of the Law, SHEKINAH will inform the Personal Data Holder of the resolution taken by the same means by which the request was made, accompanying it with the relevant evidence, if any.

When the resolution is appropriate, it will be made effective by SHEKINAH within 15 days of the communication of the resolution made.

The holder may file with the National Institute of Access to Information (INAI) a request for data protection for the response received or lack of response from SHEKINAH within 15 working days from the date on which the response is communicated to the holder by SHEKINAH and shall be subject to the provisions of the Act.

In case of requests for access to Personal Data, it will be necessary for the applicant or his legal representative to previously prove his identity.

The obligation of access to information shall be deemed fulfilled when SHEKINAH makes the Personal Data available to the holder or by issuing simple copies or electronic documents.

In the event that a person requests SHEKINAH access to their Personal Data presuming that it is responsible and it turns out that it is not, it will be enough that SHEKINAH so indicates to the holder by the means established in this section, to have the request granted.

The response to the request for access, rectification, cancellation or opposition of Personal Data will be free of charge. In case of requesting the sending of copies or other formats, the expenses derived therefrom must be covered by the Holder, costs that, at the time, SHEKINAH will inform in a timely manner to whom it may concern.

  1. c) Refusal to access Personal Data: SHEKINAH may deny total or partial access to Personal Data or to the rectification, cancellation or opposition to the processing thereof, in the following cases:
  • When the applicant is not the owner or the legal representative is not accredited to do so.
  • When SHEKINAH's database does not contain the applicant's Personal Data.
  • When the rights of a third party are injured.
  • When there is a legal impediment or resolution of an authority.
  • When the rectification, cancellation or opposition has been previously made, so that the request lacks subject matter.

VIII. DATA TRANSFER

SHEKINAH does not transfer your data to national or foreign third parties. We inform you that your personal data, including your sensitive data.

SHEKINAH reserves the right to make changes or updates to this Privacy Notice at any time, in response to legislative or jurisprudential developments, internal policies, new requirements for the provision or offering of our services or products and market practices.
